It Bears Repeating: Vices Are NOT Crimes

One of the most important timeless lessons learned, then forgotten, then learned again, then forgotten again, and so on, is Lysander Spooner's famous maxim that "vices are not crimes".  And to forget this crucial distinction, is to ultimately lead to numerous evils, from 1) amoralism and nihilism on the one hand, and 2) the most egregiously tyrannical abuses and overreach of government power (from things like Prohibition, the War on (people who use a few particular) Drugs, the 21 drinking age, tobacco bans, media censorship, restrictions on sexual activities between consenting adults, etc. all the way to slavery, eugenics, and sometimes even full-blown genocide) on the other, typically disguised as either protecting the nation's "moral fiber", and/or "progressive" social engineering for the "greater good".  In truth, it is anything but moral or progressive.  Thus, individual rights must be inalienable, and the government should never stray from its original mission of protecting life, liberty, and property.  Once the natural right to self-ownership becomes usurped by the state, the very foundation for individual rights ceases to exist, and of course that invites all kinds of trouble, as history has so painfully shown time and again.

To quote Spooner, from his Vices Are Not Crimes; A Vindication of Moral Liberty (1875):

"Vices are those acts by which a man harms himself or his property. Crimes are those acts by which one man harms the person or property of another…In vices, the very essence of crime—that is, the design to injure the person or property of another—is wanting." 
"Unless this clear distinction between vices and crimes be made and recognized by the laws, there can be…no such thing as individual right, liberty, or property; no such things as the right of one man to the control of his own person and property." 
"If these questions…are not to be left free and open for experiment by all, each person is deprived of the highest of all his rights as a human being, to wit: his right to…ascertain for himself, what is, to him, virtue, and what is, to him, vice…If this great right is not to be left free and open to all, then each man’s whole right, as a reasoning human being, to 'liberty and the pursuit of happiness,' is denied him." 
"What man, or what body of men, has the right to say, in regard to any particular action, or course of action, 'We have tried this experiment, and determined every question involved in it…not only for ourselves, but for all…And, as to all those who are weaker than we, we will coerce them to act in obedience to our conclusion?'" 
"[A] government, formed by voluntary association, would never have been thought of, if the object proposed had been the punishment of all vices…nobody…would voluntarily submit to it. But a government, formed by voluntary association, for the punishment of all crimes is a reasonable matter; because everybody wants protection for himself against all crimes by others." 
"It is a natural impossibility that a government should have a right to punish men for their vices; because it is impossible that a government should have any rights, except such as the individuals composing it had previously had, as individuals. They could not delegate to a government any rights which they did not themselves possess."

But…everybody has a natural right…to defend his own person and property against aggressors…And government has no rightful existence, except in so far as it embodies, and is limited by, this natural right of individuals...It is only those who claim that government has some rightful power, which no individual or individuals ever did, or could, delegate to it, that claim that government has any rightful power to punish vices." 
"To punish men for their vices…is a sheer and utter absurdity for any government claiming to derive its power wholly from the grant of the governed…because it would be granting away their own right to seek their own happiness." 
"Everybody wishes to be protected, in his person and property, against the aggressions of other men. But nobody wishes to be protected… against himself…He only wishes to promote his own happiness, and to be his own judge as to what will promote, and does promote, his own happiness." 
"The object aimed at in the punishment of crimes is to secure, to each and every man alike, the fullest liberty he possibly can have—consistently with the equal rights of others—to pursue his own happiness, under the guidance of his own judgment, and by the use of his own property…the object aimed at in the punishment of vices is to deprive every man of his natural right and liberty to pursue his own happiness, under the guidance of his own judgment, and by the use of his own property."
"[People]…must be permitted to control themselves and their property… each man’s life is his own."

We ignore such sound advice at our own peril.

And we know that the late Peter McWilliams, author of Ain't Nobody's Business if You Do:  The Absurdity of Consensual Crimes in Our Free Society (1996), would certainly agree with Spooner 100%.

And to avoid any weaseling, dilution, or vitiation, via subjectivism, relativism, and/or denial of agency, of Spooner's (and McWilliams') basic maxim, we should clarify that only acts that objectively harm the person or property of nonconsenting others should be considered crimes in a free society. 

People will undoubtedly ask, so what about children, or young persons below the legal age of majority?  Well, as John Stuart Mill had famously noted, such a maxim would not apply directly to them, at least insofar as consent is concerned.  But even then, to impose criminal penalties on the children or young people themselves (as opposed to the adults involved) for acts that are otherwise legal for adults while simultaneously denying them any agency to consent to such acts is the very height of hypocrisy.  And regardless, whatever age we set as the age of majority, for anyone above that age the maxim would apply completely, full stop.  In other words, in a free society, once you are an adult, you are an adult.  That is something most of the world understands.

(Note that most countries currently set that age at 18, and some set it even lower than that.  And only a few radical outliers like the USA currently set any significant age limits higher.)

Also, as Emile Durkheim famously said, "When mores are sufficient, laws are unnecessary. When mores are insufficient, laws are unenforceable".  From another angle, that is a good argument against the other side's specious claim that our society is currently somehow too immoral, weak, fractured, spoiled, undisciplined, individualistic, heterogeneous, or whatever to trust people with personal liberty and bodily autonomy.

As for the unholy trinity of collective action problems, the prevention paradox, and the (strong) precautionary principle, well, those all dovetail with begging the question and other logical fallacies, and as we have seen, slopes are much slipperier than they appear.  If you give the prohibitionists and control freaks enough rope...

And finally, there is that classic Pigouvian argument from externalities.  The best response to that is that it is literally impossible for humans to exist at all without imposing both positive and negative externalities on others to one degree or another.  And to live in any society worthy of the name, we all must tolerate some inevitable baseline level of externalities.  "No man or woman is an island" kinda cuts both ways, after all.  So arbitrarily designating select vices as crimes is both over- and under-inclusive.  And externalities are generally better dealt with via education, persuasion, and mutual consent, or failing that, via targeted Pigouvian taxes and subsidies.  Prohibition is far too blunt an instrument to deal with most externalities, and typically does far more harm than good in practice.

What Reactionaries Get Wrong About Drugs, Decriminalization, And Homelessness

Twenty-One Debunked does not take an official position on hard drugs (i.e. illicit drugs other than cannabis and some psychedelics) or the question of their legalization, but we generally lean more towards the decriminalization and harm reduction side of the spectrum as opposed to the War on (people who use a few particular) Drugs.  There is a lot of nuance that tends to get glossed over in debates that are, more often than not, typically dominated by hysterics.

Reactionaries have lately been giving some red-hot takes about the supposed perils of decriminalization and harm reduction, and often pointing fingers at Oregon for their decriminalization policy causing or exacerbating homelessness, crime, and overdose deaths.  However, such hot takes are typically completely devoid of nuance, and thus conflate correlation with causation.  Such nuances include the role of super-deadly fentanyl and its variation over time and geography, the role of the pandemic and lockdowns and their aftermath, the still-growing housing crisis, the inherent pitfalls of forced treatment, and so on.  Better articles about such nuances can be found here and here, for starters.

Those who have the GALL to oppose basic and increasingly necessary lifesaving harm reduction measures like making naloxone (Narcan) and fentanyl test strips readily available are, to put it mildly, murderously stupid.  Fentanyl often gets mixed into other drugs and can make the drug supply much deadlier than it would otherwise be.  While treatment and recovery are no doubt important goals, we also still need to meet people where they are as well.

Of course, the reactionaries do get one thing partially right, as a stopped clock always does twice a day.  There has been a general breakdown of law and order in most major North American cities in recent years due to a combination of general policy changes, anti-police sentiment, catch and release, political ideology, political correctness, and perhaps even deliberate chaos manufacture by various agents provocateur.  Of course, they should shut down and clear out the sprawling homeless encampments on the city streets and sidewalks and the open-air drug scenes that all too often go along with them.  End catch and release.  Re-criminalize theft.  Crack down on violence of all kinds.  Bring back "focused deterrence" policing, and take the classic "broken windows" theory literally.  All of these things are really just common sense, and none of them require ending harm reduction or reversing Oregon's decriminalization of simple possession of small amounts of illicit drugs.

In other words, simply enforce existing laws, and repeal bad or counterproductive ones.  But please, do it ethically, and don't let it be a springboard for an illiberal reactionary agenda.  If you feel the urge to show "tough love", look to Portugal or Alberta, not the current or historical drug warrior nations.

That said, we should always keep in mind that hard drugs called "hard" for a reason, as they are a different beast from alcohol, tobacco, and cannabis.  They may not be quite a million miles away from the latter ones, but they clearly don't belong in the same category either.  While illiberal drug policy clearly makes them much more dangerous than they have to be, they are also pretty inherently dangerous, deadly, and highly addictive in their own right as well regardless.  This is especially true for opioids in particular, as there is really no such thing as a truly safe opioid.  And we have also long known that "speed kills" and "meth is death".  And yet, unfortunately these things are still not going anywhere either.  Policymakers need to handle these things with great care as they should with any wicked problem.  And consumers would be wise to avoid these substances like the plague, especially in the age of fentanyl. 

As for the perennial wicked problem of homelessness, the housing crisis still needs to be solved before there is any hope of ending it for good.  Artificial scarcity of housing needs to end, yesterday.  And a recent study found that some form of UBI can also play a net positive role in the solution as well.  Contrary to popular opinion, spending on "temptation goods" did not actually increase for such recipients.  But good luck convincing the reactionaries of that!

The Verdict Is In: Legalizing Weed STILL Does NOT Increase Crime Rates

Recently, the modern-day "Reefer Madness"-type alarmist yellow journalist Alex Berenson has been claiming that cannabis legalization has caused huge spikes in violent crime since 2014 in the states in which it has been legalized.  He then claims that such increases in crime are somehow causally linked to the effects of cannabis (particularly via the putative and controverisal link to psychosis), and therefore to legalization as well.   But both claims are in fact highly faulty and questionable at best:  1) plenty of states, not just legalization states, saw at least modest spikes in violent crime in 2015-2016, 2) violent crime now seems to be decreasing once again regardless of legalization, 3) 2014 is an arbitrary year to choose for the base year given the timing of legalization initiatives, 4) cannabis has never been causally and conclusively linked to violence, except perhaps inversely, and 5) and most importantly, correlation does not prove causation, as so many other variables come into play here.

In fact, the latest studies on the matter have confirmed what the TSAP and Twenty-One Debunked have kinda always known.  Legalizing weed does NOT seem to increase crime rates like the prohibitionists often claimed it would, and if anything, appears to decrease violent and property crimes a bit, as well as improve their clearance rates by police.  For example, researchers found this by comparing the border counties of Washington and Oregon, whose timing of legalization differed but were otherwise quite similar. But we could've told you that years ago, for those actually willing to listen.

The theory for how legalization of cannabis would reduce crime is fairly simple.  First, it frees up relatively scarce police and other resources that would otherwise be used to bust people for weed, and allows such resources to be put to more productive uses (i.e. targeting real crime rather than victimless crime).  Secondly, cannabis is basically a non-violent drug, and can often substitute for alcohol, which is often (rightly or wrongly) linked to violence to one degree or another.  Thirdly, there is the systemic aspect, the violence linked to the illicit drug trade itself, which would self-evidently decrease if not disappear upon legalization, at least with regard to the substance being legalized. And finally, victimless crime laws, especially widely unpopular ones like cannabis prohibition (and, of course, the 21 drinking age) erode respect for the law in general and also erode cooperation and cohesion between the police and the community.  Thus, it really doesn't take a rocket scientist to see how removing such illiberal and pharisaical laws from the books would tend to decrease crime in general.

What about the opposite theory?  Not the long-debunked one that cannabis per se actually causes violent and property crime (which is rather silly on its face, mind you), but the one that claims that cannabis prohibition is a useful crime-fighting tool for police?  Well, as the saying goes, the proof is in the pudding, and we really don't see any credible evidence of that on balance.  Any utility that such an abomination would have in that regard appears to be more than outweighed by its very real downsides, and thus we can consider that theory debunked as well.

(Cue the Law and Order DUN DUN sound effect.)

We need to legalize cannabis in all 50 states and all territories as well, yesterday, and lower the age limit to 18 as well, just like our neighbor to the north.  It is LONG overdue.  So what are we waiting for?

Have We Got the "Teen Brain" All Wrong? (Part Deux)

One thing that is commonly accepted as a truism in the USA is that crime, especially violent crime, is a young person's (and especially a young man's) vice.  It typically rises rapidly in the mid-teens and peaks around the late teens and very early twenties before rapidly and then gradually declining from then on, and it is often said that "the best cure for crime is a 30th birthday."  The statistics do indeed bear this out, but it is often accepted without question that the causes of this phenomenon are biological (particularly neurological and/or hormonal) as opposed to socioeconomic or cultural ones.

Well, a new study by researchers at Penn State seems to put the lie to the biological determinist theory.   While previous studies tended to look only at Western cultures (which all show a similar age pattern for crime), this one compared the USA to Taiwan instead.  If brain development (or lack thereof) is the cause, then the age pattern for crime should be pretty much the same worldwide, but it turns out that this was not the case for Taiwan.  Over there, crime peaked in the late twenties and early thirties, roughly a decade later than in the USA.  Thus, the researchers concluded that cultural factors, not biological/neurological ones, are primarly responsible for the crime patterns by age.   Notably, this is true even though the drinking age in Taiwan is 18, compared to 21 in the USA.

These findings also dovetail rather nicely with a 2015 study by renowned sociologist and youth-rights activist Mike Males.  Using crime data from California, he found that while the typical Western age-crime pattern for homicide (peaking at age 19) held true at first without controlling for poverty, once poverty was controlled for, that pattern basically vanished for all but the poorest communities, a group in which young people just so happen to be grossly overrepresented (and not just in California either).  And while some other studies have disagreed with such findings, those previous studies have generally failed to disentangle age, period, and cohort effects, greatly confounding the results.  Thus, especially in light of the Taiwan study, we can conclude that the traditional Western age-crime pattern is largely (if not entirely) a function of poverty, not age.  Which is actually good news, given that poverty is a much easier problem to solve (at least for a wealthy and Monetarily Sovereign nation like the USA) than any neurological issues or deeply-ingrained cultural factors could ever be.

It is very rare that a single study (or two) can overturn such an apparent mountain of evidence. Unless, of course, that "mountain" turned out to be a molehill all along--and a rather shaky one at that.

What About Guns?

Normally, the gun politics debate in general is beyond the scope of Twenty-One Debunked.  But in the wake of the Parkland school shooting in Florida on February 14, 2018, in which the 19 year old killer bought the AR-15 legally, the gun debate has taken on some rather ageist overtones lately, particularly among those who generally pro-gun in general.  Both Donald Trump and Florida Gov. Rick Scott have recently revealed themselves as ageist hypocrites by pushing for raising the age limit for all guns to 21, at both the federal and state levels, respectively.   Under current federal law, the age limit for purchase is 18 for long guns and 21 for handguns, and 18 for simple possession of either type, unless the state sets a higher age limit.  (But heaven forbid these ageists even question the idea that the "right" to own weapons of war like the AR-15 is somehow sacrosanct.)

Twenty-One Debunked fundamentally opposes raising any age limit higher than 18, including but not limited to for guns.  Not only is it ageist, but it also doesn't really solve anything, since most mass shooters are over 21 and those under 21 would simply get a "straw purchaser" over 21 to buy the weapons for them, as the Columbine killers so infamously did.  If we really are serious about solving or even taking the dangerous edge off of America's practically unique gun violence epidemic, we need to get to the root of the problem rather than scapegoat young people for adult problems.

Both Twenty-One Debunked and the TSAP recommends the following measures be taken:
  1. Bring back a new and improved 1994 assault-weapons ban yesterday, this time with more teeth.  This time, include all rapid-fire devices and all magazines with more than ten rounds in the ban as well as the previously-banned types of semi-automatic rifles and their knockoffs.
  2. Remove the 20-year ban on gun violence research, yesterday. 
  3. End the gun-show loophole and implement universal background checks, yesterday.
  4. Put a significant excise tax on all bullets/ammo, like Chris Rock recommended. (Seriously)
  5. Treat ammo sales the same as gun sales.  Or better yet, treat bullets like Sudafed:  must show ID, limit on the number that one can buy, the number bought would be recorded, and if you do buy too many, you will be investigated.
  6. Pass a "one gun a month" law at the federal level.  And consider perhaps putting a limit on the number of guns that an individual can own at a given time, except for antiques/relics/curios.
  7. Require reporting of lost or stolen guns.
  8. Regulate firearms like other consumer products in terms of health and safety standards--currently such standards are nonexistent.
  9. Improve enforcement of existing gun laws, which tend not to be enforced very well these days, and improve state reporting of prohibited persons to NICS.  Also, prohibit anyone on the terrorism watch list from buying any guns, period. 
  10. Consider a massive gun buyback program, one that pays significantly more than what the guns are worth on the street.  Voluntary for any still-legal weapons, mandatory for any newly-banned ones. 
  11. And last but not least, improve our woefully-inadequate mental healthcare system.
Of course, to truly solve our gun violence problem would require a fundamental overhaul and transformation of our society, which the TSAP clearly supports.  We need to go from being what Riane Eisler calls a "dominator" society to more of a "partnership" society, as the latter kind is far less violent overall.   But in the meantime, the aforementioned recommendations would go a long way towards taking the dangerous edge off of the problem. 

While we don't know why this particular mass murderer did what he did, it was most likely due to a combination of toxic masculinity, easy access to weapons of war (including the obligatory AR-15), and some sort of grudge with the school that kicked him out.  He was also known to do reckless stuff, wanted to join the military (most likely for the wrong reasons), and apparently enjoyed hunting.  Regardless of the motive, the first two factors are absolutely essential for virtually all mass shootings, whether in schools or otherwise.

And before anyone else starts getting on their anti-youth high horse about this, keep in mind that the zero-tolerance school policies put in place in the wake of Columbine, along with the increasingly prison-like atmosphere in schools these days, have done absolutely nothing to stop school shootings from increasing dramatically since then.  Such tragic events went from occurring an average of once or twice a year in the 1990s and early 2000s to nearly once a WEEK this year so far as well as the past few years.  If anything, one can argue that the "powder keg" atmosphere made things worse in the long run.  And of course, most mass shooters in general are over 21 and the vast, vast majority are over 18.  

I don't know about you, but my favorite part of the Second Amendment is where it says "well-regulated".  Too bad so many Republican Congresscritters who are bought and paid for by the NRA can't seem to read the first half of the freaking sentence.  Oh, and nevermind that when it was written, guns at that time fired at most one round per minute, not 600+ per minute like so many of today's killing machines.  Not like the gun lobby and their lackeys really do nuance.

UPDATE:  Looks like while Trump is backing off of the idea of raising the age limit for guns to 21, Governor Scott nonetheless went ahead with it in Florida.  And the NRA is suing the state of Florida over that.

180/180: How to Clean Up Chicago (Or Any Other Major City) In 180 Days Or Less

With all of the talk about Chicago's crime wave (despite most crime being at or close to the lowest in decades nationwide), the national opioid epidemic, and the corresponding calls (mostly from the right-wing) to get "tough on crime" as well as to further reinvigorate the War on (people who use a few particular) Drugs, we at Twenty-One Debunked have decided to discuss an idea that our webmaster has been working on for almost a year now, that may one day become a full-length book.  In a similar vein as When Brute Force Fails:  How to Have Less Crime and Less Punishment by UCLA researcher Mark Kleiman, we have put together an evidence-based strategy called "180/180" (i.e. turning the crime and drug problem around 180 degrees in 180 days) that we feel jibes better with our movement.   While we borrow many ideas from Kleiman, we also reject a few of his ideas and have added several of our own as well, drawing from the vast experience of various cities, towns, and countries around the world.

Twenty-One Debunked believes that 1) the drinking age should be lowered to 18, 2) cannabis should be fully legalized for everyone 18 and older and treated no more stringently than alcohol or tobacco, and 3) all other currently illegal substances should be treated for the most part according to the Portuguese model of decriminalization of users, since full legalization of such substances (while we don't necessarily oppose doing so) is unlikely to be politically feasible at this time and could have unforseen consequences if not implemented properly.  Additionally, the True Spirit of America Party also supports abolishing (or at least greatly reducing) material poverty (which is, along with structural racism and economic inequality, one of the major root causes of both crime and substance abuse) via a Universal Basic Income Guarantee as well as a Humprey-Hawkins style Job Guarantee program.  In the long run, all of these things are likely to reduce crime and/or substance abuse overall.  But in the meantime, with or without the aforementioned measures in place, enter the 180/180 strategy to really take a bite out of crime in the near-term:

  • Implement an all-ages curfew law for the first 90 days, albeit with exceptions for people traveling to or from work or school.  Similar to what Iceland did, except for all ages and for a limited period of time.  Set it at 9 pm Sunday-Thursday and 10 pm on Friday and Saturday in general (10 pm and midnight, respectively, in the summer when days are longer).  
  • Implement a "dry law" (no alcohol can be sold, period) for the first 30 days of the strategy.
  • Increase the number of police and the number of patrols conducted, while also being careful to maintain good relations overall between the police and the community.
  • Raise the taxes significantly on all alcoholic beverages and/or set a price floor on such drinks. 
  • Put a "sinking lid" on the number and density of alcohol outlets, especially liquor stores.
  • Make simple possession of cannabis (and perhaps other drugs) and "underage" drinking the lowest law-enforcement priority (LLEP), similar to the San Francisco Miracle of the 1990s.
  • Do a "low-arrest crackdown" on any hard-drug markets, as was done in High Point, NC.  Instead of the usual catch-as-catch-can, build a case against every drug dealer in town, with enough evidence to put them away for a long time.  Then call them all in for a meeting and give them an ultimatum: stop dealing now or go to prison.  The market will dry up very quickly, and likely remain as such for years.
  • Implement Hawaii's HOPE program (for hard drugs) and South Dakota's 24/7 program (for alcohol) for probationers and parolees. 
  • Implement the strategies of Operation Ceasefire, aka the Boston Miracle, as a proven way to defuse gang violence.
  • Conduct an evaluation of the effectiveness after 180 days.  If serious crime has not dropped by at least half during that time, re-start both the curfew and dry law again, repeating as needed.  Otherwise, do not bring either one back, but maintain the other components of the strategy.

Other, medium- to longer-term measures that ought to be included in a comprehensive strategy are:

  • Get the Lead Out, and Take a Bite Out of Crime.  Numerous studies have shown a strong relationship between preschool lead exposure and later involvement in crime and other social ills during adolescence and adulthood.  (And take fluoride out of our drinking water as well, which worsens the leaching and effect of lead and is also neurotoxic in its own right.)
  • Provide free birth control to anyone who wants it, and end the current assault on women's reproductive rights, yesterday.  (Fewer unwanted children will lead to fewer criminals in the long run, according to Freakonomics)
  • Send nurses to visit the homes of first-time mothers who are poor and/or young.  According to Kleiman, this may be the most cost-effective crime-fighting program ever devised.
  • Implement sensible gun control laws (while still respecting the Second Amendment), as well as putting a tax on bullets.
  • For cities with very high crime rates, consider combining the controversial Project Exile (i.e. tougher enforcement of federal gun laws) with the aforementioned Operation Ceasefire, as was the case in the strategy known as Project Safe Neighborhoods
  • Shift the school day (for middle and high school) to both start and end later.
  • Raise the minimum wage.  (Yes, studies do show a correlation)
  • Implement a "Housing First" approach to solving homelessness.
  • Invest more in education in general, from pre-K through post-grad.
  • Invest more in both mental health and substance abuse treatment programs, as well as substitution therapy (methadone, buprenorphine) for opioid addicts.
  • Provide more opportunities for alternative forms of recreation, like Iceland did.
  • If we find we must follow the "broken windows" theory, think James Q. Wilson (who invented it), NOT Rudy Giuliani.  Do NOT use racial profiling or police brutality, or anything else that violates anyone's civil or human rights, period.
  • And for crime in general, we must always keep in mind that swiftness and certainty of punishment works better than random severity.  Punishment is a cost, not a benefit.
And of course, all of these things have social benefits that go way beyond simply fighting crime as well.  The evidence is overwhelming, so what are we waiting for?

We have been trying to get "tough on crime" for decades now.  It's time to get SMART on crime instead.

180/180: How to Clean Up Chicago (Or Any Other City) in 180 Days or Less

With all of the talk about Chicago's crime wave (despite most crime being at or close to the lowest in decades nationwide), the national opioid epidemic, and the corresponding calls (mostly from the right-wing) to get "tough on crime" as well as to further reinvigorate the War on (people who use a few particular) Drugs, we at Twenty-One Debunked have decided to discuss an idea that our webmaster has been working on for almost a year now, that may one day become a full-length book.  In a similar vein as When Brute Force Fails:  How to Have Less Crime and Less Punishment by UCLA researcher Mark Kleiman, we have put together an evidence-based strategy called "180/180" (i.e. turning the crime and drug problem around 180 degrees in 180 days) that we feel jibes better with our movement.   While we borrow many ideas from Kleiman, we also reject a few of his ideas and have added several of our own as well, drawing from the vast experience of various cities, towns, and countries around the world.

Twenty-One Debunked believes that 1) the drinking age should be lowered to 18, 2) cannabis should be fully legalized for everyone 18 and older and treated no more stringently than alcohol or tobacco, and 3) all other currently illegal substances should be treated for the most part according to the Portuguese model of decriminalization of users, since full legalization of such substances (while we don't necessarily oppose doing so) is unlikely to be politically feasible at this time and could have unforseen consequences if not implemented properly.  Additionally, the True Spirit of America Party also supports abolishing (or at least greatly reducing) material poverty (which is, along with structural racism and economic inequality, one of the major root causes of both crime and substance abuse) via a Universal Basic Income Guarantee as well as a Humprey-Hawkins style Job Guarantee program.  In the long run, all of these things are likely to reduce crime and/or substance abuse overall.  But in the meantime, with or without the aforementioned measures in place, enter the 180/180 strategy to really take a bite out of crime in the near-term:

  • Implement an all-ages curfew law for the first 90 days, albeit with exceptions for people traveling to or from work or school.  Similar to what Iceland did, except for all ages and for a limited period of time.  Set it at 9 pm Sunday-Thursday and 10 pm on Friday and Saturday in general (10 pm and midnight, respectively, in the summer when days are longer).  
  • Implement a "dry law" (no alcohol can be sold, period) for the first 30 days of the strategy.
  • Increase the number of police and the number of patrols conducted, while also being careful to maintain good relations overall between the police and the community.
  • Raise the taxes significantly on all alcoholic beverages and/or set a price floor on such drinks. 
  • Put a "sinking lid" on the number and density of alcohol outlets, especially liquor stores.
  • Make simple possession of cannabis (and perhaps other drugs) and "underage" drinking the lowest law-enforcement priority (LLEP), similar to the San Francisco Miracle of the 1990s.
  • Do a "low-arrest crackdown" on any hard-drug markets, as was done in High Point, NC.  Instead of the usual catch-as-catch-can, build a case against every drug dealer in town, with enough evidence to put them away for a long time.  Then call them all in for a meeting and give them an ultimatum: stop dealing now or go to prison.  The market will dry up very quickly, and likely remain as such for years.
  • Implement Hawaii's HOPE program (for hard drugs) and South Dakota's 24/7 program (for alcohol) for probationers and parolees. 
  • Implement the strategies of Operation Ceasefire, aka the Boston Miracle, as a proven way to defuse gang violence.
  • Conduct an evaluation of the effectiveness after 180 days.  If serious crime has not dropped by at least half during that time, re-start both the curfew and dry law again, repeating as needed.  Otherwise, do not bring either one back, but maintain the other components of the strategy.

A Critique of Barnum et al. (2012)

A new study by Barnum et al. (2012) on drinking age law enforcement was recently published online this month.  In this first-of-its-kind study, using data from 1975-2006 they find that birth cohorts exposed to tougher enforcement of PAULA (possession of alcohol under the legal age) laws (as measured by underage drinking arrest rates) from ages 15-20 had modestly lower arrest rates for assault and vandalism between the ages of 15-24.  This remained true even when age effects, period effects, relative cohort size, and percentage of nonmarital births were controlled for.   But was it really a causal relationship?

While the authors appear to be convinced that this relationship is causal, we at Twenty-One Debunked note that there are plenty of reasons that this relationship could easily be spurious.  For example:
  • Several other potentially important variables were not controlled for, including ones that may not have been captured by age and period effects.
  • State-to-state variation was not explored at all.
  • Arrest rates may have given biased estimates due to underreporting and changes in reporting rates and police practices over time, which can yield specious inferences.
  • The strengths of the underage drinking laws themselves were not explored, only the enforcement of such laws as measured by arrest rates.
  • Cohorts exposed to drinking ages of 18, 19, 20, and 21 were all lumped together, with no attempt to distinguish between them.
  • No other crimes were explored besides assault and vandalism, and no distinction was made between types of assault (i.e. simple vs. aggravated).
  • Allocating more resources towards arresting underage drinkers (and those who commit other victimless crimes) takes away from resources used to fight real crime, including assault and vandalism.  So, an increase in the former could lead to a spurious decrease in arrests for the latter in the absence of any real change in the latter.
Even if we accept the authors' conlcusions at face value, arresting underage drinkers does not appear to be a particularly cost-effective crime reduction strategy from a public safety standpoint.  The study reported that for every full unit increase in underage drinking arrests, there was only a 0.125 unit decrease in assault arrests and a 0.134 unit decrease in vandalism arrests.  Other sources note that on average, for every 1000 or so incidents of underage drinking, only one PAULA arrest occurs, making it a highly inefficent use of resources.  Law enforcement resources would thus be better spent actually targeting real crimes rather than victimless ones like underage drinking.

The example of San Francisco is highly instructive in this regard.  In 1990-1992, they were a crack-infested, gang-ridden hellhole.  By 2000, violent crime had plummeted by half (and even more so for juveniles), and by 2009 they became one of the safest big cities in America.  And how did they manage to do this?  Did they employ a "broken-windows," zero-tolerance approach to the most minor offenses, especially by young people?  Hardly!  In fact, beginning in 1992 (the city's peak year for violent crime), they stopped enforcing their youth curfew law (which was completely abolished in 1995), and since then they have actually cut back on arresting young people for "status" offenses (such as underage drinking) and cannabis possession, making such offenses the lowest priorities.  In other words, "don't sweat the small stuff."   Meanwhile, the police freed up more resources to tackle serious crime, and managed to build better relations with the community.  While the exact reasons for the drop in crime are not entirely clear, and several other cities nationwide saw similar improvements, it certainly casts doubt on the authors' thesis that cracking down on underage drinking reduces crime.

Interestingly, 'Frisco teens also show significantly lower rates of violence, "binge" drinking, driving after drinking, drinking in general, cannabis use, huffing, and crack/cocaine use compared with the national average according to the Youth Risk Behavior Survey.   Furthermore, the rates in San Francisco are comparable to or lower than those in NYC (and dropped at a similar or faster rate) despite the latter city's notoriously heavy-handed police tactics under Mayors Giuliani and Bloomberg.
